By accessing our website https://insurancemasiha.com or engaging our services for insurance grievance redressal, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

2. Services Offered

Insurance Masiha is dedicated to assisting policyholders across India in resolving insurance-related disputes. Our scope of work is strictly limited to the following:

2.1 Resolution of Insurance Complaints

We provide consultancy to rectify grievances related to insurance policies, covering:

  • Mis-selling: Wrong policies sold by Intermediaries, including Individual Agents, Banks, or Corporate Agents.

  • Claim Rejections: Disputes regarding Health, Life, or General Insurance claims.

  • Procedural Delays: Unreasonable delays by the Insurance Company.

Our objective is to mediate disputes effectively and draft technical representations for the Client.

2.2 Legal Advisory & Support

Our team provides guidance to clients involved in insurance litigation (Consumer Forum/Ombudsman).

  • Note: We guide you through the legal framework to ensure your rights are defended, but we act as consultants, not as a substitute for a practicing litigation lawyer in court.

3. User Obligations

Your engagement with our services implies your agreement to the following strict obligations:

3.1 Integrity of Information

You agree to provide accurate, complete, and honest information regarding your policy, medical history, and claim facts.

Strict Warning: If it is found that you have provided fake documents, concealed material facts (e.g., pre-existing diseases), or provided misleading information to us, Insurance Masiha reserves the right to immediately terminate the contract and stop all services. No further assistance will be provided in such cases.

3.2 Adherence to Laws

You agree to use our services for lawful purposes only, in compliance with the Insurance Regulatory and Development Authority of India (IRDAI) guidelines and the Indian Penal Code.

3.3 Prohibited Conduct

You must refrain from using our platform for fraud, unauthorized access, or abusive behavior towards our staff. Violation of this clause may lead to legal action.

4. Fees and Payment Policy

Since we are a service-based consultancy:

  • Registration/MOU Charges: Any initial registration fee or MOU (Memorandum of Understanding) charge is for file processing and administrative setup. This fee is non-refundable.

  • Professional Fees: We charge for our time, expertise, drafting, and documentation efforts.

  • No “Success Guaranteed” Model: We do not work on a model where fees are contingent upon the guaranteed success of a claim, as the final decision lies with the Insurer or the Court.

5. Limitation of Liability

Please read this section carefully.

  • No Guarantee of Results: Insurance Masiha puts in the best professional effort to resolve your claim. However, we DO NOT guarantee that the Insurance Company or Ombudsman will approve your claim. The final decision is theirs alone.

  • Financial Loss: We shall NOT be liable for any direct, indirect, or consequential damages (including financial loss) arising from the rejection of your claim or delays in the process.

  • Third-Party Actions: We are not responsible for the actions, errors, or negligence of the Insurance Company, TPAs (Third Party Administrators), or Legal Courts.

6. Intellectual Property Rights

Insurance Masiha asserts exclusive ownership of all content on this website, including texts, logos, case studies, and draft formats.

  • Restrictions: Users are prohibited from reproducing, copying, or distributing our content for commercial purposes without prior written consent. Unauthorized use constitutes a violation of Copyright laws.

7. Confidentiality

We respect the privacy of your sensitive data.

  • Data Protection: Any medical records, policy documents, or financial details shared by the Client will be kept strictly confidential and used solely for the purpose of resolving the insurance complaint.

  • Disclosure: We do not share your personal information with third parties unless required for the case (e.g., sharing with the Insurance Ombudsman) or by law.

8. Dispute Resolution and Governing Law

  • Governing Law: These Terms shall be governed by the laws of India.

  • Jurisdiction: Any legal proceedings or disputes arising out of these Terms shall be exclusively brought before the Courts located in New Delhi/Delhi.

  • Mediation: We encourage users to resolve disputes amicably through negotiation before initiating legal proceedings.

9. Amendments to Terms

  • We reserve the right to revise these Terms at any time without prior individual notification.

    • Responsibility: It is your responsibility to review these Terms periodically. Your continued use of our services after any changes indicates your acceptance of the revised Terms.
